I. Consent
  By entering your personal data and confirming your consent by mouse-click during your registration with fairpartners, you agree that the operator of fairpartners, Skill Portal AG, may process and use your personal data to carry out and administer the internet services offered by fairpartners and for the other purposes mentioned below.

You are entitled to withdraw your consent at any time with future effect.
II. General Principles
  Data protection and security are of high priority to fairpartners. The long-term protection of your company data and in particular your personal data are especially important to us.
1. Data Protection
  Skill Portal AG as operator of www.fairpartners.com is primarily subject to the provisions of the Federal Data Protection Act ("BDSG") in respect of the collection and processing of personal data.

This section on data protection explains, in terms of these regulations, which personal data – during your registration process and your use of the platform – fairpartners may record and how this information is processed and used by fairpartners. Furthermore, the following points define in writing which data can be made available, and for what purpose (§ 10 BDSG). However, this section does not apply to companies referred to by means of a link on fairpartners’ website or to companies on whose websites fairpartners is referred to by means of a link. 

fairpartners reserves the right to amend the information provided in this section without notice, in alignment with changes in legislation, court decisions or commercial legal proceedings. The current version of this section, as published here, shall apply. Insofar as required by law in this respect, fairpartners will obtain your consent again.
2. Data Security
  We have setup numerous technical and operational safeguards to protect your personal data held by fairpartners from unauthorised access and misuse. For the transfer of data, fairpartners offers you the opportunity to transfer this in encoded form. fairpartners uses the SSL (Secure Socket Layer) encoding method, a recognised and widespread system in the internet, e.g. as used by banks for internet banking. Each current version of SSL is considered to be secure. The security procedures used by fairpartners are checked regularly and updated to meet the latest technical standards. Details regarding technical and organisational measures undertaken to guarantee data security (§ 9 BDSG) remain undisclosed for security reasons. 
III. Collecting and Processing Data as Part of the Registration / Authorisation Process
  The full use of the procurement platform www.fairpartners.com requires registration with and approval by fairpartners, of the company and/or businessman. In these processes fairpartners collects company data and the personal data of the contact person in order to make a binding decision on authorisation and to guarantee the best possible operation of the internet services provided by fairpartners.
1. Which Personal Data does fairpartners collect in the Registration / Authorisation Process?
  In the registration and authorisation process fairpartners currently collects some of the following compulsory personal information:

contact details (telephone number, e-mail address)
 

If the user is a sole trader, the company data collected by fairpartners such as industry, commercial activity, company profile etc. also constitute personal data. Information on partners, company holdings, managing board members, supervisory board members etc. also constitutes personal data.

2. How and for what purpose does fairpartners use the above personal data?
  fairpartners uses the stored data solely for its own purposes in order to guarantee the operation of the services offered and in order to improve fairpartners' internet service. At the end of the relationship with the user and/or with a change in contact person, fairpartners will immediately remove the possibility to retrieve contact person data. Until complete deletion of the data after ten years, it remains stored exclusively for auditing purposes and for preserving evidence.

fairpartners also uses the personal data for marketing purposes such as sending emails with important information or of an advertising nature. If you do not wish to receive any of this information, you may cancel this under the heading "Newsletter" at any time.

fairpartners will not pass on the above data to other external third parties as long as it is not compelled to do so by any official order on the part of the authorities, or if the user has not given his express consent to do so.

In performing its activities outside Germany fairpartners may call on the assistance of associations and companies (country partners) in each respective country. Users based outside Germany expressly agree to the transmittal of their registration and master data to fairpartners' respective country partners. 
IV. Collecting and Processing Data While Using the procurement platform 
  While the platform is being used personal data required by the system will be stored and information, requests for quotations, as well as goods and services on offer entered by the user will be recorded.

  Currently, fairpartners collects the following data:

2. How and for what purpose will fairpartners use the above personal data?
  fairpartners will use the data collected by the system firstly to produce general statistics of use. The use and analysis of this data are to manage and improve fairpartners' internet services. Secondly fairpartners will collect and permanently store the personal data collected by the system for security purposes for a period of ten years.

Purchasers can see whether and which suppliers have visited the requests for quotations they have initiated. Suppliers agree to this data being passed on to the purchaser. 

Depending on the business model and purpose the data entered by the user will, with the exception of username and password, be published (in the public area) or passed on to other authorised users (in the non public user area):
  • company profiles, company master data as well as offers of goods and services are visible to third parties in the public area of the platform;
  • Contact person data is visible in the public area where the Administrator has specified this;
  • requests for quotations are visible in the non public user area of the platform to authorised and invited suppliers. Bids from suppliers are visible to the relevant purchasers.
The processing of the entered data is for initiating and administering agreements between users or users and third parties respectively via fairpartners. Authorised users are contractually obliged to use the data transmitted by fairpartners exclusively for the purpose stated and in compliance with the law.

fairpartners will also permanently store the entered data for auditing purposes and for producing meaningful statistics for a period of ten years, to be made available (in part) to users by fairpartners as part of their internet services. The data will also be stored as reliable evidence of misuse and to combat the same.

In addition, fairpartners will not pass on any of the above data collected by the system and entered to any external third party, unless officially ordered to do so by the authorities or unless the user has given his express consent to do so. For users based outside Germany, fairpartners' country partners are deemed to be a socalled non-third party within the meaning of this clause. 
V. Cookies
  fairpartners currently uses temporary cookies in order to make its internet services userfriendly, more effective and safer.
These so-called "session cookies" will be deleted at the end of each of your internet visits to fairpartners. For the purposes of improving, expanding and/or in respect of any other changes to the internet services offered by fairpartners, we reserve the right to use permanent cookies in future. 
VI. Information and Making Contact; Directory in accordance with §§ 4g Section 2 Clause 2, 4e Clause 1 of the "BDSG". 
  In fairpartners' administration area you can view your master data, company profile, requests for quotations and/or bids at any time. You can amend your master data yourself at any time.
